1. Who you are contracting with
DebateGuard (the "Service") is operated by DebateBogdan(the "Seller", "we", "us"), trading as DebateGuard. By creating an account or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
DebateGuard is an AI tool that transcribes spoken debates and attempts to flag false or misleading claims in real time. Outputs are indicative only, may contain errors, and are not legal, medical, financial, or other professional advice. You are responsible for verifying anything important.
3. Accounts
You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be at least 13 years old (or the minimum age in your country) to use the Service.
4. Acceptable use
You agree NOT to:
- use the Service unlawfully or to infringe anyone's rights;
- record people without the consent required by your local law;
- spam, harass, defame, or spread targeted disinformation;
- upload malware, probe, scrape, or otherwise interfere with the Service;
- reverse engineer the Service or circumvent technical limits;
- generate content that is illegal, hateful, sexual content involving minors, or designed to deceive specific real people ("deepfakes" without consent).
5. Your content and IP
You keep ownership of the transcripts and content you create. You grant us a limited license to host and process that content solely to provide the Service to you. We retain ownership of the Service, software, and branding. We may remove content or restrict accounts that breach these Terms.
6. Subscriptions, billing, and Merchant of Record
DebateGuard Pro is a paid subscription that costs USD $5/month, billed monthly. New subscribers may receive a 7-day free trial; your card is charged at the end of the trial unless you cancel before it ends. Subscriptions renew automatically until cancelled. You can cancel any time from your account settings or by contacting us; cancellation stops the next renewal.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries for payment and handles refunds and returns. Payment, billing, taxes, and refund mechanics are governed by Paddle's Buyer Terms and Refund Policy, together with our own Refund Policy.
7. Refunds
We offer a 30-day money-back guarantee. See our Refund Policy for how to request a refund via Paddle.
8. Service availability
The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or that AI outputs will be accurate. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
9. Limitation of liability
To the extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury where the law forbids such limits.
10. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated/serious policy violations. You can stop using the Service at any time and delete your account from settings.
11. Changes
We may update these Terms. We will post the new "Last updated" date above and, for material changes, notify you in-app or by email. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Romania, without regard to conflict of law rules. Disputes will be brought before the competent courts of Romania, unless mandatory consumer law in your country gives you the right to sue locally.
